Terms of Sales

 These conditions are subject to change at any time; the customer is therefore invited to consult them regularly. The applicable conditions are those in force on the site on the date the order is placed.

1 – PREAMBLE

Animalins is a company located in Beaucaire, in the Gard, France.
It specializes in the online sale of NUTRIVET kibbles for dogs and cats. It does not have a store apart from its website.
The site is the property of Animalins in its entirety, as well as all the rights relating thereto.

2 – PRICES

The prices of our products are indicated in euros, including all taxes and excluding processing and shipping costs.
In the event of delivery to a country other than metropolitan France, the recipient of the order will be considered as the importer of the product(s) concerned. For all products shipped outside the European Union and for the DOM-TOMs, the price will be automatically calculated excluding taxes on the invoice.
All orders, whatever their origin, are payable in euros during the day of the order.
Animalins reserves the right to modify its prices at any time and without notice, but the products will be invoiced on the basis of the prices in force at the time of the registration of the orders subject to availability on that date. All prices are subject to manifest typographical error.
The products remain the property of Animalins until full payment has been received.

3 - ORDER

The buyer declares to be at least 18 years old and to have the legal capacity or to hold parental authorization allowing to place an order on the site.
When ordering, the buyer agrees to the accuracy of the information provided. The order becomes effective when the customer has validated the entry of his credit card number and its expiry date or when we receive his payment by check or transfer. We confirm by email the correct registration of orders. This email constitutes our acceptance of your order and thus forms the sales contract between the parties. Another email is sent on the day of shipment with the details of the shipment made.
Animalins reserves the right to cancel or refuse any order from a customer with whom there is a dispute relating to the payment of a previous order. We reserve the right to ship only available quantities. No modification may be made to the order by the buyer. 4 – VALIDATION By declaring to have read and accepted these General Conditions of Sale and by clicking on the "validation" button after the ordering process, the buyer declares to fully and unreservedly accept this order. The data recorded by Animalins constitutes proof of all transactions between Animalins and its customers. Animalins will systematically confirm your order, then its shipment by email.
 






Our product offers and our prices are valid as long as they are visible on the site. They are offered within the limits of available stocks.

6 - PAYMENT

Payment for purchases is made by credit card, check, bank transfer or Paypal.
The bank cards accepted are: Visa, Eurocard, Master Card, American Express... The bank card will be debited when the order is registered.

In the event of a bank transfer, the customer must mention in the transfer order all the necessary information. The transfer costs remain at his expense. The order will be shipped as soon as the transfer is effective. The bank details of Animalins appear on the site during the validation of the order.
Any order not paid within 15 days will be automatically canceled.

7 - SECURITY

Our site is subject to one of the most efficient security systems at present, the universal SSL encryption process. For your security, confidential bank card information is not communicated to us and therefore does not risk being stolen from us.

 
8 - INVOICE
 
The order form on the customer establishes online is not worth an invoice. Whatever the method of payment, the customer receives his invoice in his package.

9 - DELIVERY CONDITIONS AND TIMES

As regards deliveries in the BEAUCAIRE sector and its surroundings (maximum 30kms), they will be carried out by us 

The offer is in full compliance with French law and it is the responsibility of the foreign buyers to comply with the import laws in force in their states or in their countries.

The products will be sent to the delivery address that the buyer indicated during the ordering process.
Participation in shipping costs is inclusive of VAT.
All our shipments are confirmed by email.
For shipments outside the European Union, any taxes (local, customs or import VAT) may be invoiced on arrival of the package at destination and will remain the responsibility of the recipient.

The times indicated are average times given for information only. They correspond to processing and delivery times. Lead times vary by destination and do not include holidays or weekends. For most destinations, the average delivery time is between 4 and 12 days. The delay can in no case be a reason for cancellation of the order and does not give right to any compensation.

In case of payment by check, the order will only be processed upon receipt of the check. Consequently, the deadlines applicable in this case are those on the day of receipt of the check and can therefore be modified in relation to those mentioned on the day of placing the order.

In the event of a strike slowing down or preventing the delivery of the products, Animalins will make every effort to keep its customer informed of the status of the shipment of his package.

Any anomaly noted on the appearance of the parcels (damaged parcels, already opened, etc.) during delivery must imperatively be the subject of reservations on the delivery receipt for any subsequent complaint. Complaints concerning the condition or the contents of the parcels must be reported by registered letter with AR upon receipt and without ever exceeding 72 hours to Animalins in order to be taken into account (article 105 of the Commercial Code). Beyond this period, no complaint will be accepted and even less admitted to oppose the payment of the order.

10 - SHIPPING COSTS

Shipping costs are invoiced according to the weight of the parcel, the delivery time, the place of destination and the carrier chosen.

11 - RETURN, EXCHANGE OR REFUND

In accordance with the consumer code Art L 121-16, the buyer has the right of withdrawal of 7 days from the delivery of the order (and undertakes to inform the seller by email within this time limit) to return any product that is not suitable without having to justify a reason.

We undertake to refund or exchange defective products or products that do not correspond to the order. The request must be made within 15 working days of delivery. The products must be returned to us in the state in which they were received with all the elements delivered (accessories, packaging, etc.) and accompanied by a copy of the purchase invoice.
On the other hand, we will not be able to take back:
items returned incomplete, damaged, damaged or soiled by the customer,
- items without labels,
- packages for which no element identifying the sender will be specified (order number, surname, first name, address).
Reimbursement or exchange will take place as soon as possible after receipt of the products by us. Only the price of the product(s) purchased will be refunded. The return costs will be borne by the sender, the parcels traveling under his responsibility. The products must be sent to:

No return shipment against reimbursement will be accepted for any reason.

12 - GUARANTEES AND LIABILITY

The buyer benefits from the provisions of the legal guarantee against hidden defects (article L211-1 of the consumer code).

The products offered comply with the French legislation in force. Animalins cannot be held liable in the event of non-compliance with the legislation of the country where the products are delivered (for example in the event of a product ban). It is up to the buyer to check with the local authorities the possibilities of importing or using the products or services he plans to order.

Animalins declines all responsibility for the misuse of the products that the customer has ordered. The photographs and texts reproduced and illustrating the products presented are not contractual. Consequently, Animalins cannot be held liable in the event of an error in one of these photographs or one of these texts. The buyer will refer to the description of each product to know its precise characteristics; and in case of doubt he can contact our company directly. Animalins can not be held responsible for the non-performance of the contract concluded in the event of out of stock or unavailability of the product, force majeure, disruption or total or partial strike in particular of the postal services and means of transport and / or communications , flood, fire.
Animalins will not incur any liability for any consequential damages as a result of these presents, operating loss, loss of profit, loss of opportunity, damages or costs.

13 - APPLICABLE LAW - DISPUTES

These general conditions of sale are subject to French law and the Vienna Convention on contracts for the international sale of goods. The nationality of the customer, the country of delivery, the currency used for payment or the language used for the order form or the description of the products do not in any way constitute a derogation from the application of French law to govern the relationship between the customer and seller.
The language of this contract is French.
Any dispute relating to the interpretation or execution of orders will be examined with the greatest care and will be the subject of an immediate amicable proposal. If this fails, the dispute will be settled definitively by the NIMES COMMERCIAL COURT.

14 - CUSTOMS DUTIES

There are no customs duties within the European Union.

Any order placed on our site and delivered outside the European Union and in the DOM-TOM may be subject to taxes and/or customs duties collected on delivery. These customs duties and any taxes related to the delivery of an item are the responsibility of the recipient and are his responsibility both in terms of declaration and payment to the authorities and/or competent bodies of the country concerned. Animalins is not required to verify or inform the buyer of applicable customs duties and taxes. To know them, the buyer will have to inquire with his local administration. The declared value of the goods corresponds to the price indicated on the online catalog and on the order form.

15 - VALUE ADDED TAX (VAT)

VAT applies to sales concluded with residents of the European Union. It does not apply to non-French companies in the European Union with an intra-community VAT number. They must send us an order by fax or post on the company's letterhead with an indication of their intra-community VAT number. In the event of an online order, Animalins recommends that the customer choose bank transfer as the method of payment to avoid being debited the amount of French VAT; indeed, our online card payment system does not yet allow us to automatically process the case of non-French companies with an intra-community number (Belgium for example). Sales from mainland France to the overseas departments and territories are tax-free. Products are taxed at

The VAT rate applied depends on the country of delivery of the goods. It is, as a percentage of the value of the goods sold, 20% for delivery in mainland France, Corsica or Monaco.

All texts, comments, works, illustrations and images reproduced on the site  https://www.animalins.fr are reserved under copyright as well as intellectual property and for the whole world. As such and in accordance with the provisions of the Intellectual Property Code, only use for private use subject to different or even more restrictive provisions of the intellectual property code. Any other use constitutes counterfeiting and is sanctioned under Intellectual Property without the prior authorization of Animalins. Any total or partial reproduction of the Animalins site is strictly prohibited.
The goods delivered remain the property of Animalins until full payment of their price.

18 - PERSONAL INFORMATION – PROTECTION OF PERSONAL DATA

Animalins undertakes not to disclose to third parties the information provided by buyers and visitors to its site. These are confidential. They will only be used for order processing, to reinforce and personalize communication (commercial letters / informational emails, improvement of the site according to user suggestions).
This article cannot prevent the assignment or transfer of activities to a third party. Therefore, in accordance with the Data Protection Act of 6 JANUARY 1978, the buyer has a right of access, rectification and opposition to personal data concerning him.
